This Privacy Policy explains how we protect personally identifiable information provided through our platform. The term "EduCrack", "us","we",or "our" refer to EduCrack Pvt Ltd. The term "you", "your" refers to users and viewers of this site.

We do not share any of your information with any third party. We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. None of your information including your performance on tests will be shared with any third party.

Some of your performance information may be shown anonymously to other registered users of the site if you are in the topper's list (or similar) of a defined category. We may release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect our’s or others’ rights, property, or safety.

We use your data to provide and improve the complete user experience on our platform. By using the EduCrack platform, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

Our Terms and Conditions (“Terms”) govern all use of our platform and together with the Privacy Policy constitute your agreement with us (“Agreement”). In addition to the terms stated in Terms and Conditions provided under this Website/mobile application (together “platform”), we are committed to protecting your privacy. Only authorized representatives of EduCrack, on a need to know basis, may use any information received from you. We constantly review our systems and data to secure your personal information. We will investigate any complaint or such actions with a view to prosecuting and/or taking civil proceedings to recover damages against those responsible. Any User who does not agree with any provisions of this Privacy Policy document and the Terms of Service is mandatorily expected to leave the platform immediately. Should you disagree with this Policy (defined below) and still continue to access the platform and provide your personal information, EduCrack disclaims all the liabilities arising therefrom and it shall be assumed by your continued use of the platform that you have accepted the Privacy Policy and any other online terms and conditions available on the platform.

Your Responsibilities

You are responsible for maintaining the confidentiality of your Username, Registered email and password.

You are responsible for maintaining the security of your Username and Password. You may not provide these credentials to any third party. If you believe that they have been stolen or been made known to others, you must contact us immediately at support@educrack.in, but in any event you should change your password immediately. We disclaim any responsibility if someone else accesses your account through Registration Information they have obtained from you or through a violation by you of this Privacy Policy.

A feature of the site allows a user to access another user's (or friend's) score by entering both the other user's (or friend's) username and registered email. Hence it is your responsibility to ensure that you do not reveal both your username and registered email on the site with anyone else apart from those with whom you are willing to share your performance data. EduCrack does not take any responsibility for the loss in confidentiality of your username and registered email through actions that are out of EduCrack's control.

Applicability

This privacy policy (“Policy”) applies to all Users who access the platform and are therefore required to read and understand the Policy before submitting any Personal Information (defined hereinafter). If you have inadvertently submitted any Personal Information to EduCrack prior to reading the Policy statements set out herein, and you do not agree with the manner in which the Personal Information is collected, stored or used, then you may access, modify and delete all information stored about You by writing to us at support@educrack.com. EduCrack keeps personal data of the User, and every User is also entitled to require EduCrack to delete and destroy all such information (but not that of other Users).

This Policy applies to the platform and any other services that are owned and operated by EduCrack . Third party platforms may place their own cookies or other files on the Users' computer, collect data or solicit personal information from the Users, for which EduCrack is not responsible or liable. Accordingly, EduCrack does not make any representations concerning the privacy practices or policies of such third parties or terms of use of such platforms, nor does EduCrack guarantee the accuracy, integrity, or quality of the information, data, text, software, sound, photographs, graphics, videos, messages or other materials available on such platforms. The inclusion or exclusion does not imply any endorsement by EduCrack of the platform, the platform's provider, or the information on the platform. EduCrack encourages the User to read the privacy policies of that platform.

EduCrack has taken all reasonable precautions to treat Personal Information as confidential with industry standards that it has implemented to protect from unauthorized access, improper use or disclosure, modification and unlawful destruction or accidental loss of the Personal Information.

Access

Users are allowed to access the platform, register for the free courses and avail free services available with EduCrack as a guest and without creating an account on the platform or providing any Personal or Sensitive Information. EduCrack takes no responsibility or validates the information provided by the guest, except as otherwise required under any law, regulation or an order of competent authority. In order to have access to all the features and benefits on our platform, a User is required to first create an account on our platform. To create an account, a User is required to provide Personal Information as may be required during the time of registration. Other information requested on the registration page, including the ability to receive promotional offers from EduCrack, is optional. EduCrack may, in future, include other optional requests for information from the User to help EduCrack to customize the platform to deliver personalized information to the User. Without the User's agreement, EduCrack will not share, rent or sell any Personal Information with third parties in any way other than what is disclosed in this Policy. EduCrack may keep records of telephone calls received and made for making enquiries, registered courses, feedback or other purposes for the purpose of rendering services effectively and efficiently.

Information We Collect

We collect information from you when you register on our site or fill out a form. You may, however, also visit our site anonymously but to use any features, you will need to register. If a particular feature requires a fee, then we collect credit card and other payment related information.

We may also collect technical and navigational information, such as computer browser type, Internet protocol address along with other data that browsers send when you land on our platform, pages visited, and average time spent on the site.

1. INFORMATION COLLECTED FROM YOU
   • When you use the Platform by way of registration, log in, creation of a user account or creation of a post, purchase of a test series, attempting a mock test, etc. or by way of interaction via third party websites and/or mobile applications or by way of any other communication with the Platform, EduCrack may collect your personally identifiable information including name, date of birth, gender, demographic information, photos, e-mail address, telephone number, mobile phone number, credit card or debit card details, geographic location, mailing address, social media account details including list of contacts/friends and examination preference. EduCrack will use this information to validate you as a user when using the Platform, to provide the Service to you, including administration of your user account, to notify you of changes to the Service or about any changes to our terms and conditions or this privacy policy, to manage its business, including financial reporting and billing of its Service, for the development of new products and services, to send you newsletters, offers and promotion coupons to market and advertise its products and services by email, to comply with applicable laws, court orders and government enforcement agency requests, for research and analytic purposes including to improve the quality of the Service and to ensure that the Service is presented in the most effective manner for you and your device.
   • By registering on the Platform, you agree and confirm your consent to providing EduCrack with your aforementioned personal information, which is lawful, necessary and permissible. You at all times have the right to discontinue the use of the Platform. EduCrack is not liable to provide you with its Services in the absence of or your refusal to provide the aforesaid information. Additionally, EduCrack is not liable to ensure or maintain the same quality of its Services to you, as it may for a user who provides all aforementioned information.
   • Any information provided by you under EduCrack’s "create a post" feature, comments, upvotes or otherwise any information that you provide on the Platform is not personal information and shall become part of EduCrack’s published content. EduCrack may use the aforementioned information without your consent for purposes including but not limited to improving its products and services, developing new products and services and sending you messages about promotions and offers.
2. Information Collected Automatically
   • When you visit or interact with the Platform, apart from EduCrack certain third party advertisers and/or service providers may use technologies that automatically collect information about you for both transactional (e.g., confirmation of registration, notification of purchase made, etc.) and promotional (e.g., promotions, newsletters, etc.) purposes. Your information may be collected by EduCrack or such third party advertisers and/or service providers in the following ways
   • Log Files: Every time you visit the Platform, EduCrack servers automatically receive and log information from your browser and device used to access the Platform (such as IP address, device ID, details of your network operator and type, your operating system, browser type and version, CPU speed, and connection speed). This enables us to validate you as a User, to understand your usage of the Platform and helps us to make changes and updates most suited to your needs and interests.
   • Mobile Device: When you register your mobile device or use the mobile device to access the App, In addition to the aforesaid, EduCrack will also collect device information such as mobile device ID, model and manufacturer details, operating system etc. for improving the App’s overall functionality and displaying the content according to your preferences.
   • Cookies: Cookies are data files placed on your device, used to keep track of information such as your interaction with social media platforms, the content you click on, download, upload or share and other activity on the Platform etc. in order to improve your experience of the Platform by personalizing it to your preferences and usage trends. We use cookies to compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future. We may enter into a contract with third-party service providers to assist us in better understanding our platform visitors. These service providers are not permitted to use the information collected on our behalf except to help us conduct and improve our business.
   • Web Beacons: Web beacons are transparent graphic images used in our email communication to you, in order to understand customer behaviour and improve the overall quality, functionality and interactivity of the Platform.
   • Mobile Analytics: Mobile analytics software is used by EduCrack to better understand and customize the functionality of the App’s software on your phone. This is done by collecting information such as your frequency of the App’s usage, the features you prefer to use on the App, where the App was downloaded from, Device Id, name of other mobile applications on your device, etc.
   • Payment /Purchase Information: In order to access certain paid features and services on the Platform, you may be required to create or log into a separate account on a payment gateway or website such as “GPay”, “PayU” or “PayTM''. Once such an account is created, in order to process your payments/ purchases on the Platform, such payment gateway providers may require and collect your details such as name, address, phone number, email address and credit or debit card information, net banking information or details of any web wallets maintained by you. Any/all payment(s) made/processed or details provided to or shared with such authorized payment gateway providers shall be stored directly by such payment gateway providers without any information passing through or related to EduCrack. EduCrack disclaims any liability in respect of such payments and/or information shared with or provided to such authorized payment gateway providers. It is further clarified that the aforementioned information is only used in accordance with the provisions of the applicable law and in strict adherence to this Privacy Policy.
   • Public Forums: Any information that is disclosed by you in the comments section or by way of the “EduMeet” feature, becomes published information and EduCrack shall not be held liable for the security of the same or any personal information that you disclose herein. You agree to exercise caution when disclosing any personal information or personally identifiable information in this regard.
3. Please note: We only use the aforesaid information to communicate with and/or improve the services and user experiences and also to better understand our users' operating systems, for system administration and to audit the use of the Service. We do not use any of the aforesaid data to identify the name, address or other personal details of any individual.
4. For the purpose of this Privacy Policy, any passwords, financial information such as credit or debit card details or other payment instrument details and any additional information prescribed by law to be sensitive that may be collected by EduCrack during your use of the Platform and its Services provided thereon, shall be referred to as "Sensitive Personal Data or Information".

Use of the Collected Information

Any of the information we collect from you may be used in one of the following ways:

1. To personalize your experience: Your information helps us to better respond to your individual needs.
2. To improve our platform: Technical and navigational information may be used, for example, to alert you to software compatibility issues, or it may be analyzed to improve our Web design and functionality. We continually strive to improve our platform offerings and service based on the information and feedback we receive from you.
